If a court of appeals affirms a defendant's conviction, the last option is Supreme Court review. However, the Supreme Court grants review of an extremely small percentage of the petitions that are presented to it. It therefore is imperative to find a seasoned appellate litigator with Supreme Court experience in order to have the best chance of obtaining Supreme Court review.

The first step in the Supreme Court review process is to file a petition for a writ of certiorari. In many ways, it is more difficult to convince the Court to grant review of a case than it is to prevail on the merits. A lawyer generally must convince the Court that the case is significant and/or involves a disagreement on an issue among the federal courts of appeals. That is why it is important to have an experienced Supreme Court practitioner prepare a cert. petition. In the time I was at the Department of Justice, I briefed fourteen criminal cases on the merits before the Supreme Court, after the Court had granted cert. And, when I was in private practice prior to working for the Department of Justice, I managed to convince the Supreme Court to grant certiorari in a case, and we went on to win that case on the merits.

I assist lawyers and individuals who want to take a case to the Supreme Court by:

  • Preparing a petition for a writ of certiorari
  • Filing briefs on the merits if certiorari is granted
  • Preparing for and presenting oral argument

I will select the best issue or issues in your case that might spark the Court's attention, and will craft a petition for a writ of certiorari that best presents those issues. Should the Court grant review of your case, I will then marshal my experience and brief-writing skills to prepare a brief on the merits on your behalf.
